Last Updated: October 2, 2025

1. ACCEPTANCE OF TERMS

By accessing or utilizing Dental AI's scheduling intelligence platform ("Service"), you ("Customer," "User," or "you") hereby agree to be bound by these Terms of Service ("Terms"). If you are entering into this agreement on behalf of a dental practice, healthcare organization, or other legal entity, you represent and warrant that you possess the legal authority to bind said entity to these Terms.

2. SERVICE DESCRIPTION

Dental AI is a Software-as-a-Service (SaaS) solution engineered to provide scheduling intelligence for dental practices. The Service is designed to optimize clinical schedules, enhance operational efficiency, and improve practice productivity. The platform integrates with practice management systems, including Open Dental, and processes Protected Health Information (PHI) in strict compliance with all applicable healthcare regulations.

3. HIPAA COMPLIANCE AND DATA PROTECTION

3.1 Business Associate Agreement

By using the Service, Customer acknowledges that Dental AI functions as a "Business Associate" as defined under the Health Insurance Portability and Accountability Act (HIPAA). A separate Business Associate Agreement (BAA) must be executed between the Customer and Dental AI before any PHI is processed through the platform. This BAA will govern the use and protection of all PHI.

3.2 Data Security Standards

Dental AI implements and maintains a comprehensive security program with robust technical, administrative, and physical safeguards designed to protect Customer data. These measures include:

  • End-to-end encryption of all PHI in transit and at rest, using AES-256 or a higher standard.
  • Multi-factor authentication (MFA) and role-based access controls (RBAC) to enforce the principle of least privilege.
  • Regular security risk assessments, vulnerability scanning, and third-party audits.
  • Adherence to all required safeguards under the HIPAA Security Rule.

3.3 AI Processing and PHI

All processing of PHI by our AI algorithms occurs within a secure, HIPAA-compliant infrastructure. The Customer retains full ownership of all its clinical and patient data. Dental AI does not use identifiable PHI for the general training of its AI models. Any data used for system improvement is fully de-identified and aggregated in accordance with HIPAA standards.

4. USER RESPONSIBILITIES AND ACCEPTABLE USE

4.1 Account Security

The Customer is responsible for all activities that occur under its accounts. Customer must:

  • Maintain the strict confidentiality of all user login credentials and security tokens.
  • Implement and enforce appropriate user access controls within their own organization.
  • Promptly notify Dental AI in writing of any known or suspected security breaches or unauthorized use of the Service.
  • Ensure all personnel accessing the Service are appropriately trained on HIPAA and internal security policies.

4.2 Prohibited Uses

Customer agrees not to, and not to permit its users to:

  • Share, sell, or transfer user access credentials to any unauthorized individual or third party.
  • Use the Service for any purpose other than its intended use for clinical and practice operations.
  • Attempt to decompile, disassemble, reverse engineer, or otherwise discover the source code or underlying algorithms of the Service.
  • Introduce any malicious code, viruses, or harmful data into the platform or attempt to gain unauthorized access to our systems.
  • Process PHI through the Service without having obtained all legally required patient consents and authorizations.

5. INTELLECTUAL PROPERTY RIGHTS

5.1 Dental AI's Intellectual Property

Dental AI retains all rights, title, and interest in and to the Service and all related intellectual property, including but not limited to its software, AI algorithms, methodologies, documentation, and user interface. Customer is granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service strictly during the subscription term and in accordance with these Terms.

5.2 Customer Data

Customer retains all ownership rights, title, and interest in and to all its data, including practice data, clinical information, and PHI ("Customer Data"). Dental AI claims no ownership rights over Customer Data.
